The defendant was convicted of the double murder of Stanley Montaro and Mary Munoz, aged twenty-three and twenty years, respectively, committed in a suburban district of San Leandro, county of Alameda, this state, on December 19, 1929. The indictment upon which he was convicted contained two counts, and the jury returned a verdict of guilty of murder of the first degree, without recommendation of imprisonmen';, upon both counts.
