Upon plaintiff’s petition filed February 5, 1944, the trial court issued writ of habeas corpus for the purpose of inquiring into defendants’ alleged unlawful detention of plaintiff’s legally-adopted six-year-old son, Karl Francis Liebert. Defendants answered denying plaintiff’s right to the custody of said child. The matter was brought on for hearing, testimony was taken, and the trial court entered an order dismissing plaintiff’s petition and granting defendants custody of the child.
