OPINION AND ORDER

BESOSA, District Judge.

On October 20, 2006, the International Longshoremen’s Association-AFL-CIO, Local 1575 1 (“ILA”) filed this complaint against Horizon Lines of Puerto Rico (“Horizon”) seeking damages for an alleged breach of the Collective Bargain Agreement (“CBA”)in which the parties had entered. Jurisdiction is invoked pur suant to Section 301(a) of the Labor Management Relations Act, 29 U.S.C. § 185(a), 28 U.S.C. § 2201(a), 2202 and Rule 57 of the Rules of Civil Procedure.
