This action was commenced in the district court of Okmulgee county by defendant in error herein, Tell Thames, against the plaintiff in error herein, Jarecki Manufacturing Company, a corporation, and R. G. Rapp. The parties will be referred to as they appeared in the trial court.

The action of the plaintiff was for burial expenses of his five-year old son, whose death was alleged to have been occasioned by the negligence of the defendants, through their agents and servants, in the operations of loading of easing upon their ricks in their storage yards in the city of Okmulgee, and…
