OPINION
LEDERBERG, Justice.
Following the condemnation of its land by the State of Rhode Island (state), Ocean Road Partners, a business partnership, petitioned the Superior Court for an assessment of damages. Ocean Road Partners has appealed to the Supreme Court the resulting assessment of damages made by the Superi- or Court. In addition, the state has cross-appealed the denial of its motion for reimbursement to the state of the amount of its past payment to the partnership that exceeded the Superior Court’s assessment of damages.
