Quo icarranto upon the relation of the attorney general to test the right of respondent to hold the office of alderman from the seventh ward in Minneapolis. The facts are not in dispute and may be summarized thus: Oscar J. Turner was an alderman of the seventh ward, duly elected and qualified. In December, 1934, he-resigned to accept the office of comptroller of the city, thereby creating a vacancy in the council.
