OPINION

FIRESTONE, Judge.

TMs tax refund case comes before the court on cross-motions for summary judgment. The plaintiffs, Jonathan Palahnuk (“Palahnuk”) and Kimberly Palahnuk (collectively, “plaintiffs”), argue that they are entitled to a refund of $627,019 of their federal income tax for tax year 2000 in connection with certain stock options they had-exercised through a margm loan in that year.
