1 Reported in 234 N.W. 1. Frederik Bakke, the county treasurer of Marshall county, and the sureties on his official bond appeal from the order denying a new trial, findings of fact and conclusions of law having been in favor of plaintiff.
Upon taking his office as county treasurer in January, 1923, defendant Bakke gave his official bonds to the county with the other defendants as sureties. He had for many years previously served as county treasurer of Marshall county. Pursuant to G.
