This case stems from a dispute over the effects of the termination of an oil, gas, and mineral lease and a joint operating agreement (JOA). The lease in question, the Baker Lease, is located in McMullen County. The Baker Trusts, represented by Bank of America, and the Rutherfords1 are lessors of the Baker Lease. The Bank and the Rutherfords each own a 25% mineral interest subject to the Baker Lease. The remaining 50% mineral interest is equally split between the Rutherfords and the drilling company.
