MEMORANDUM

MERHIGE, District Judge.

This matter is before the Court on Defendants’ motion to strike Plaintiffs request for a jury trial. For the reasons which follow, the Court will deny the motion.

Plaintiff, an alleged beneficiary of a health insurance plan funded by her husband’s employer, sought treatment for depression at an institution which was considered a “non-network provider.” Plaintiff avers that the subject plan was obligated to provide benefits up to 50% of the cost of care provided by non-network providers.
