OPINION AND ORDER

This matter is before the court on defendants’ motion to dismiss for failure to state a claim. For the reasons set forth below, the motion is GRANTED in part and DENIED in part.

I. Factual and Procedural History

In August 1999, plaintiff Tammie Sanford Lamberty entered into an employment agreement with defendant Premier Millwork and Lumber Co., Inc. (“Premier”). (Comply 5.)
