MEMORANDUM OPINION AND ORDER

CARRIGAN, District Judge.

This diversity action arises out of an injury to the plaintiff Todd P. Brown that occurred on August 2,1983. The following facts are not genuinely disputed: Plaintiff was performing a temporary two-month job for his employer, the intervenor Sigma Geoservices, Inc. (“Sigma”) in Bunker Hill, Kansas. Sigma had supplied the pickup truck that Brown used on the job. While Brown was working under the truck’s hood, the battery exploded in his face, causing permanent disability to his left eye.
