This matter is presently before the Court on defendants’ motion for summary judgment. Plaintiff Karim Menebhi (“Menebhi”) brought this action against defendant Thomas Mattos (“Mattos”), in his official capacity as Finance Director for the Town of East Greenwich, Rhode Island (“East Greenwich”), and defendant William Higgins (“Det. Lt. Higgins”), individually and in his capacity as Detective Lieutenant for the East Greenwich Police Department. Plaintiff brought this action against defendants pursuant to 42 U.S.C. § 1983.
