The state seeks review of a Court of Appeals’ decision that upheld the trial court’s order granting defendant’s pretrial motion to suppress evidence seized by the police during a warrantless search of defendant’s store. The Court of Appeals, in banc, affirmed the trial court’s decision that the police invaded defendant’s constitutionally protected privacy interests when they searched for and seized evidence without a warrant and before obtaining defendant’s consent, and held that that evidence must be suppressed.
