MEMORANDUM OPINION AND ORDER

This matter is pending for consideration of Defendants Diversified Clinical Services, Ine.’s (“DCS”), and Austin Day’s Motion for Summary Judgment and Motion for Sanctions. [Record Nos. 36, 43] The defendants contend that there are no genuine issues of material fact and that they are entitled to judgment as a matter of law. [Record No. 36] Additionally, they seek sanctions against Plaintiff Marla Montell and her counsel for filing and maintaining the Complaint which they assert is frivolous.
