Petitioned obtained an alternative writ of mandate to require the district court to settle her bill of exceptions or show cause why it should not do so.

Plaintiff recovered a verdict on the first trial against the defendant corporation and another. The trial court granted the motion of defendants in that case for a new trial, but no formal written order was prepared, signed or entered. Only a minute entry was made.
