This action arises out of an automobile-pedestrian collision which occurred at the intersection of Washington Boulevard and 37th Street, just south of the south territorial limit of the city of Ogden in Weber County, on the 8th day of February, 1938. On that occasion the plaintiff and his wife, Geraldine Chatelain, were walking upon the highway when they were struck by an automobile driven by the defendant, Howard A. Thackeray.
