OPINION

On the 15th day of June, 1933, the Superintendent of Banks of the State of Ohio took possession of the assets of The Guardian Trust Company, for the purpose of liquidation. Upon examining the records and assets of the bank, the Superintendent discovered that certain mortgages and notes in a separate file in the Mortgage Loan Department were marked with the legend “ST. 324,” and that in the Trust Department there was a record entitled, “Sundry Trust No. 324,” which manifestly had relation to the notes and mortgages-bearing that legend.
