We have before us an appeal on questions of law from a judgment of the Court of Common Pleas of Cuyahoga County against two defendants in the amount of Nine Thousand, Nine Hundred and Seventy-five Dollars with interest.
The cause was tried on an agreed statement of facts which reflect that the defendant John Gallagher and the decedent, Michael J. Gallagher, his father, on March 1, 1962, opened a joint and survivorship savings account in the amount of $10,000 at the Kenmore branch of appellee bank.
