GAINES, Chief Justice.

This is a petition for a writ of mandamus, 4md is an outgrowth of the same case which gave rise to the suit of Schintz v. Morris, in which a certificate of dissent from the Court of Civil Appeals of the Third District was dismissed by this court for want of jurisdiction. We there held that it was not a case in which we had power under the Constitution and Statutes to revise the rulings of the Appellate Court. The nature of that proceeding appears from our opinion rendered at a former day of the present term.
