This is an appeal from a judgment in favor of defendant after an order sustaining a demurrer to plaintiff’s complaint without leave to amend.
The complaint set forth the following allegations: Defendant is the duly appointed and acting executrix of the estate of W. C. Fields, who died on December 25, 1946. Plaintiff married decedent in California on April 8, 1900, and was his wife at all times thereafter until his death.
