Mrs. Ethel Bush Ittner sued New York Life Insurance Company to recover an amount alleged to be due under a policy of life insurance issued to her husband, Arthur E. Ittner, by the defendant, in which the plaintiff was beneficiary, under the double-indemnity provision in the policy which provided for the payment of an indemnity upon receipt of due proof that the “death of the insured resulted directly and independently of all other causes from bodily injury effected solely through external, violent, and accidental cause,” where such death occurred within ninety days after the injury was…
