This is a suit upon a policy of life-insurance issued by the plaintiff in error upon the life of Mattie L. Durden, brought *799by the defendant in error as guardian for the beneficiaries named in the policy. The answer of the plaintiff in error set up various defenses, only one of which is to be' considered here under the evidence, viz., that the insured committed suicide, whereby the plaintiff in error was discharged from liability under the policy; thus claiming the protection afforded by section 2500 of the Civil Code of 1910.
