Defendant Illinois Farmers Insurance Company (“Farmers”) moves this Court to dismiss Plaintiff Scott Dolemba’s Second Amended Complaint (“SAC”), R. 42, which alleges that Farmers violated the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227, and the Illinois Consumer Fraud Act (“ICFA”), 815 ILCS 505/2, under an agency theory of vicarious liability.
