Appeal from Folk District Court. — Lester E. Thompson, Judge. Action in equity, to enjoin the city council of the city of Des Moines from enforcing certain provisions of an ordinance licensing and regulating the business of taxicab owners and drivers. Plaintiff’s petition was dismissed by the court below, and he appeals. —

— I. It is alleged in. plaintiff’s petition, and admitted in the answer of defendants, that appellant is a resident of the city of Des Moines, and engaged in the business of operating taxicabs for hire, soliciting passengers for transportation, and transporting them from place to place in said city.
