In this employment discrimination and retaliation action, the Court is called upon to decide whether Plaintiffs state law claims under the New Jersey Conscientious Employee Protection Act (“CEPA”), N.J.S.A. 34:19-1, et seq., and the New Jersey Law Against Discrimination (“LAD”), N.J.S.A. § 10:5-1, et seq., are pre-empted by Section 301 of the federal Labor Management Relations Act, 29 U.S.C. § 185 (“LMRA”), which exclusively governs disputes between parties to a labor contract where a party has alleged a violation of the collective bargaining agreement (“CBA”)…
