OPINION
IRENAS, Senior District Judge.
Before this Court is Defendant’s Motion to Dismiss pursuant to Federal Rules of Civil Procedure, Rule 12(b)(6). 1 Defendant argues that Plaintiffs state law claim under the Conscientious Employee Protection Act (“CEPA”), N.J.S.A. 34:19-1, et seq., is preempted by § 301 of the federal Labor Management Relations Act of 1947 (“LMRA”), 29 U.S.C. § 185. Plaintiff argues that the LMRA does not extend to his claims. 2
For the reasons that follow, the Court holds that § 301 of the LMRA does not preempt Plaintiffs CEPA claim. In light of our decision this matter…
