David Shuck was charged on November 7, 2011, with five counts: conspiracy to manufacture 100 or more marijuana plants in violation of 21 U.S.C. §§ 846, 841(b)(l)(B)(vii); manufacture of 100 or more marijuana plants in violation of 21 U.S.C. § 841(a)(1), (b)(l)(B)(vii); two counts of the use and maintenance of a place for the purpose of manufacturing marijuana in violation of 21 U.S.C. § 856(a)(1), (b); and possession of marijuana with intent to distribute in violation of 21 U.S.C. § 841(a)(1), (b)(1)(D).
