Appeal from a judgment of the Supreme Court (Sheridan, J.), rendered October 26, 1999 in Rensselaer County, upon a verdict convicting defendant of the crimes of sexual abuse in the first degree, assault in the second degree and criminal contempt in the second degree (two counts).
In the early morning hours of January 28, 1999, defendant allegedly engaged the victim, with whom he previously had been engaged in an extramarital relationship, in unwanted, forceful sexual contact.
