This was an action for partition of real estate. Appellant was one of the defendants below. The complaint alleged that appellees and appellant were owners as tenants in common of certain real estate; that such real estate was not susceptible of partition in kind; and asked that it might be sold and the proceeds divided according to the interests of the parties. The petitioners based their right for partition upon the fact that they and the defendants below were the heirs of one Rachael Cochran, deceased, who died seized the owner of the real estate in controversy.
