MILLER, Associate Justice.

On November 11, 1933, Donald L. Underwood, for himself and six others—four of whom are, with him, appellees herein— located a placer claim upon an area of 130 acres, with four-fifths of a mile of water front, along the east bank of the Columbia River in the State of Washington, approximately one and one-half miles downstream from the site of the Grand Coulee Dam. The location was intended to cover a sand and gravel deposit which, it is contended, constituted a valuable mineral deposit.
