This is an appeal on questions of law from an order of the Common Pleas Court dismissing plaintiff’s petition. On August 28,1959, plaintiff filed an action in the United States District Court for the Northern District of Ohio, Eastern Division, under the Federal Employers’ Liability Act, Title 45, Section 51 et seq., U. S. Code, in the sum of $250,000 for personal injuries allegedly caused by the negligence of the defendant railroad.
