{¶ 1} The state appeals from the decision of the Wayne County Municipal Court. This court reverses.

{¶ 2} On January 8, 2007, Gary Bickel was charged with one count of being an intoxicated pedestrian on a public highway, in violation of R.C. 4511.481, one count of failure to control, in violation of R.C. 4511.202, and two counts of driving under the influence, in violation of R.C. 4511.19(A)(1)(a) and R.C. 4511.19(A)(1)(d). Bickel pleaded not guilty to these charges. Simultaneously, Bickel was charged with one count of obstructing official business, in violation of R.C.…
