Defendant discharged plaintiff from employment for the stated reason of poor work performance. As a result, plaintiff filed this lawsuit alleging causes of action for breach of contract, nonpayment of wages in violation of the South Carolina Wage Payment Act (S.C.Code Ann. §§ 41-10-10 to -110), age discrimination in violation of the Age Discrimination in Employment Act (“ADEA”) (29 U.S.C. §§ 621-34) and the South Carolina Human Affairs Law (“SCHAL”) (S.C.Code Ann. §§ 1-13-10 to -110), fraud, and intentional infliction of emotional distress.
