OPINION

FOLEY, Judge.

Israel Lopez, a Cuban refugee, appeals from a May 23, 1985 post-conviction order denying his motion to withdraw his guilty plea. Lopez pleaded guilty to a lesser charge of possession of marijuana with intent to distribute under a plea negotiation. He was sentenced on May 8, 1984. As a result of this case and a related case pending in federal court, 1 deportation proceedings were initiated by the Immigration and Naturalization Service (INS). On April 23, 1985, Lopez moved to withdraw his guilty plea, alleging that he was not properly advised of immigration consequences…
