Order, Supreme Court, Bronx County (Dominic Massaro, J.), entered on May 29, 1996, granting defendant’s motion to dismiss the indictment pursuant to CPL 30.30, unanimously reversed, on the law and on the facts, the motion denied, the indictment reinstated and the matter remitted to the Supreme Court for further proceedings.
