Appeal from a judgment of the circuit court for Kenosha county: E. B. Beldeu, Circuit Judge. The appellant, a corporation organized under the general railroad act of the state of Wisconsin and operating its line by electric power, in ISToyember, 1905, filed its petition for condemnation, in which it averred that the lands belonged to one of the respondents, Thomas B. Jeffery, and prayed that the whole of the lands described in the petition be taken.

The commissioners awarded damages for the entire property described in the petition, and the appeal was from the award, neither party appealing from the order determining that it was necessary to take the whole of the land described. The appellant paid into court, in conformity with *9the statute, the amount of the award, and entered into possession of the property taken.
