The plaintiff on the 29th day of February, 1904, delivered to the Flatbush Trust Company the sum of $45,000 and executed with the Flatbush Trust Company a trust deed, under and by virtue of which the said trust company was “ to have and to hold the same * * * as trustee, in trust to invest and keep invested the same, with power to call in and change the investments thereof from time to time and *131to collect and receive the income thereof, and after paying thereout all lawful expenses and charges to apply the net income from the said trust estate arising to the use of the party of the first part…
