The plaintiff, St. Germain & Son, Inc. (contractor), brought an action of contract against the defendant, Taunton Redevelopment Authority (Authority). The plaintiff’s declaration contained three counts labeled (1) breach of contract, (2) quantum meruit, and (3) action on a written contract, respectively. The action was tried before a jury in the Superior Court, and the jury returned a verdict in the sum of $20,000 on count 3.
