THIS MATTER comes before the Court on Defendant Leslie S. Robins’ Motion to Dismiss All Claims Brought by Advanced Optics Electronics, Inc. and Claims of Racketeering Brought by Biomoda, Inc., filed October 9, 2007 (Doc. 15)(“Motion to Dismiss”). The Court held a hearing on January 22, 2008. The primary issues are: (i) whether Advanced Optics Electronics, Inc. (“ADOT”) has authority to bring a suit against Defendant Leslie S.
