OPINION
LESLIE, Judge.
This is an appeal by the relator, J.E.K. Industries, Inc., from a determination by the commissioner of economic security that the employee, John Foy, should be allowed unemployment benefits. We find that the commissioner’s decision is unsupported by substantial evidence, and we therefore reverse.
FACTS
The respondent, John Foy, was employed by J.E.K. Industries from May, 1970 until May 18, 1983. At the time he left his employment with J.E.K., Foy held the position of vice president in charge of sales and marketing. In 1972 Foy had purchased 5 percent of the stock of J.E.K.,…
