Defendant Yonehama is in the business of owning and operating restaurants. In 1992, it signed a 10-year lease with the Port Authority for restaurant space in the Northeast Plaza Building of the World Trade Center. During the bidding process for the design and construction of the restaurant, the plaintiff, SKR Design, submitted numerous proposal letters to Yonehama on its letterhead bearing the legend "Interior Designers Planners Architects."
