Before the Court is Defendants’ motion to dismiss (No. 5) and Plaintiffs’ opposition thereto (No. 7). Plaintiff Betzaida Mangual (“Mangual”), individually and as the representative of the estate of her late husband, José A. Rosa-Rodríguez (“Rosa”), and their minor children Cassandra Maria Rosa-Mangual and José M. Rosa-Mangual (collectively, “Plaintiffs”), brought this action pursuant to 42 U.S.C.
