This matter is before the Court on Plaintiffs Motion for Partial Summary Judgment [Doc. No. 47] and Defendant’s Motion for Summary Judgment [Doc. No. 51].1 For the reasons set forth herein, Plaintiffs motion is granted in part and denied in part and Defendant’s motion is *1067granted in part, denied in part, and denied without prejudice in part.
