Defendant on December 8, 1967, was confined at California State Prison at San Quentin as a sexual psychopath 1 under a commitment issued by the Superior Court in Riverside County on March 12, 1963, pursuant to the then extant provisions of the Welfare and Institutions Code. He appeals from a judgment of conviction which on August 13, 1968, sentenced him to state prison following a jury verdict which found him guilty of possession of a sharp instrument on December 8, 1967, while confined in a state prison, a violation of the provisions of section 4502 of the Penal Code. 2 The…
