This is an interlocutory appeal of a pretrial evidentiary ruling. The defendant is charged with assault with intent to commit crimi nal sexual conduct involving penetration. The issue presented concerns the admissibility of evidence of prior sexual conduct between the complainant and the defendant. The circuit court held that the evidence was admissible. However, the Court of Appeals reversed. We conclude that the Court of Appeals improperly ordered that the evidence be excluded.
