For purposes of this decision, we need only say that the appellant was charged with, tried for, and convicted of negligent homicide. Appellant’s motion for new trial was denied on March 15, 1965, after which his trial counsel withdrew and his present counsel took charge of the case. Present counsel, sometime after timely notice of appeal was given, discovered that the jury list in Chelan County was not prepared in strict compliance with RCW 2.36.060, which provides as follows:
