This matter is before the Court for disciplinary action upon review of the April 2005 Final Report and Recommendation (“Final Report”) of the Board on Professional Responsibility (“Board”). The Respondent, Darryl K. Fountain (“Fountain”), has been a member of the Bar of this Court since 1984. The Board has recommended a one-year suspension with the possibility of applying for reinstatement after six months, if certain conditions are met.
