Appeal from an order of the Family Court of Cortland County (Campbell, J), entered August 6, 2004, which granted petitioner’s application, in a proceeding pursuant to Family Ct Act article 10, to adjudicate respondent’s grandchild to be neglected.

In January 1989, respondent was granted custody of her granddaughter, Amanda (born in 1988), who suffered from numerous physical ailments from the time of her birth. In 1991, the child was diagnosed with Epstein-Barr virus which continued to reactivate either into further episodes of that virus or mononucleosis. In 1997, she sustained a cerebral…
