OPINION and ORDER
DALTON, District Judge.
On July 14,1977 the plaintiff, an association of apple growers, was granted a temporary restraining order against the Secretary of Labor and the Regional Administrator of the Employment and Training Administration, Region III, of the United States Department of Labor. A hearing was held on July 21, 1977 on plaintiff’s motion for a preliminary injunction. The Migrant Legal Action Program, Inc., of Washington, D. C., was granted leave to appear as Amicus Curiae and participated fully in the hearing.
